Terms of Service

1. Accepting these Terms

By creating an account, joining a Pexplora event workflow, activating Race Beacon, using a connected integration, or otherwise using the services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the relevant service.

2. Accounts and access

You are responsible for providing accurate account information, protecting your login credentials and using the service only through access granted to you. During Private Beta, access may be invitation-only and functionality may change without the stability or support commitments of a generally available product.

• You must not share credentials in a way that enables unauthorized access.
• You must not attempt to bypass plan, event, security or access controls.
• You are responsible for activity performed through your account unless caused by a failure within Pexplora's control.

3. Endurance planning and fitness information

Pexplora provides route analysis, training context, readiness indicators, strategy, fueling reminders, navigation, race guidance and other endurance information. These outputs are tools to support your judgment. They are not medical advice, diagnosis, emergency services, or a guarantee of safety, performance, finish time, cutoff success or race outcome.

Outdoor and endurance activities involve risks including weather, terrain, fatigue, navigation error, device failure and connectivity loss. You remain responsible for evaluating conditions, following event rules, carrying required safety equipment, and deciding whether to start, continue, modify or stop an activity.

4. Routes, navigation and GPS

Maps, GPX files, route geometry, elevation, surface information, navigation cues and location data can contain inaccuracies or become outdated. GPS accuracy varies by device, terrain and environment. You should verify critical route information against official event materials, local signage and reliable navigation sources.

5. Connected services and devices

Pexplora may connect to third-party platforms or devices such as supported fitness providers, Android Health Connect and compatible wearable experiences. Availability depends on the third party, your device, permissions, internet/Bluetooth connectivity and provider policies. A third party may change or discontinue an API or service outside Pexplora's control.

6. Race Companion

Race Companion is intended to keep selected mission information and guidance accessible during an activity. Some functions may operate offline while others depend on a phone, Bluetooth connection, internet access or backend availability. Haptic alerts, fueling reminders, checkpoint prompts and live guidance are aids only; you are responsible for confirming that an action is appropriate before following it.

7. Race Beacon, Race Relay and Race Control

Race Beacon and Race Control are event-operation tools. If you activate Race Beacon for an event, your location and race telemetry may be made available to authorized organizers and event staff for operational purposes as described in the Privacy Policy.

BLE Race Relay is an optional mechanism designed to help carry encrypted telemetry through nearby Pexplora runners when mobile coverage is unavailable. Delivery can be delayed or fail because of range, terrain, power management, Bluetooth settings, device compatibility, battery level or lack of an onward internet connection.

Race Beacon and Race Relay are not emergency beacons and are not substitutes for official race safety systems, satellite communicators, emergency services or event-mandated tracking equipment.

8. Organizer responsibilities

An organizer using Race Control is responsible for its event, participant communications, event rules, checkpoint operations, staff permissions and any notices or consents the organizer is required to provide. Organizers must not use Pexplora data for unrelated surveillance, advertising, discriminatory decisions or purposes inconsistent with the event and applicable law.

9. User content and permissions

You retain ownership of content you upload or create, including routes, posts, profile images and club content. You grant Pexplora a limited permission to host, process, reproduce and display that content as necessary to provide the service and the sharing settings you choose. You must have the rights needed to upload or share the content.

10. Acceptable use

You may not misuse Pexplora, interfere with the service, probe for vulnerabilities without permission, automate abusive access, upload malicious code, impersonate another person, falsely claim an event identity or bib, use data to harass or endanger others, or use Pexplora in violation of applicable law.

11. Free, Pro and paid services

Pexplora may offer free and paid features. Current entitlements, limits and prices are shown in the product or applicable store at the time of purchase and may change prospectively. If a subscription is sold through an app store or payment provider, billing, cancellation and refund mechanics may also be governed by that provider's terms.

12. Intellectual property

Except for user content and third-party materials, Pexplora software, branding, interfaces, designs, documentation, algorithms, text and other service materials are owned by or licensed to Pexplora Technologies and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of Pexplora technology to you.

13. Service changes, suspension and termination

We may add, change, suspend or discontinue features, especially during Private Beta, and may restrict access where reasonably necessary for security, maintenance, abuse prevention, legal compliance or protection of users and the service. You may stop using Pexplora at any time and may use available account-deletion controls subject to our retention obligations.

14. Disclaimers

Pexplora is provided on an “as available” basis to the extent permitted by law. We do not promise uninterrupted availability, perfect GPS accuracy, continuous connectivity, error-free third-party integrations, or that every recommendation will suit every athlete or event. Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.

15. Liability

To the extent permitted by applicable law, Pexplora Technologies is not responsible for indirect, incidental, special or consequential losses arising from use of the service, loss of connectivity, third-party systems, user decisions, outdoor hazards or reliance on non-authoritative guidance. Any limitation applies only to the extent permitted by law and does not exclude liability that cannot legally be limited.

16. Governing law and disputes

These Terms are governed by the laws of Malaysia, without limiting any mandatory consumer rights that may apply to you. Before starting formal proceedings, we encourage you to contact us at hello@pexplora.com so we can try to resolve the issue.
